General Terms
Upon commissioning, the client fully agrees with the terms listed hereunder. The artist is not responsible if the client fails to read the TOS here provided.
The client will receive a full resolution .png file as well as a smaller resolution, watermarked .png file for social media sharing.
I. Copyright and Commercial Use
The artist holds full rights to share the creation process of the artwork publicly, such as (but not limited to): Livestreams & posts on any social media. If the client wishes to keep their commission private, previous agreement is required.
The artist will not sell and/or make profit of any product sold unless the client has broken any of the TOS.
The client is allowed to sell, post, print, use on advertisements, assets and other commercial uses free of any charge.
The client is not allowed to claim my work as their own. The client is allowed to claim character/IP rights over the portrayed material, not the art itself.
The client agrees that any version, modified or not, of the artwork shall never, in any way, shape or form, be used as a Non Fungible Token (NFT) or in AI datasets/training. In the event of any of these malpractices being applied, the client loses all rights over the product, while the artist gains full rights (commercial and personal) over said product.
The client is not allowed to modify the product in ways such as:
The watermark is not visible
The image is resized
The transparency is modified
The text (if contained) is hateful/harmful propaganda
The artwork isn't recognizable
II. Payment and Delivery
The client shall pay 50% of the value within 48 hours after the sketch has been approved, in case of failing to do so, the commission may be cancelled.
The client shall pay the remaining 50% within 48 hours after the artwork is delivered. In case of failing to do so, the client loses any rights over the material and may be put on a permanent Blacklist.
II-II. Cancellation and Refund
In the event of cancellation by the artist, a full refund shall be provided to the client.
In the event of a chargeback after the product was turned in, the client loses all of the rights over the material and may be put on a permanent Blacklist. The artist gains the full rights to full profit from said material. (legal actions may apply)
In the event of cancellation by the client, the following amounts shall be refunded:
Cancellation after sketch approval: 90%
Cancellation after lineart is done: 30%
Cancellation after the colouring is done: 0%
III. Customer Satisfaction
The client has the right to request modifications (big or small) only on the sketch phase up to three (3) times free of charge. After that, +1 USD is charged for each consecutive change. (Small colouring corrections not included)
Once the final product has been turned in, no further revisions will be provided by the artist.
If the client does not respond to crucial inquiries by the artist, the progress is obstructed, therefore being subject of cancellation within 48 hours.
If the client demands the product is finished within 2 months or less, a ''rush fee'' of 30% over the full price shall be applied.
The Terms here listed may be tweaked if both parts agree on it through any sort of written means.
